Costas Constantinou says that with Flashpark there are no set up costs, but in fact the company charges a set-up fee of £138.

Does the FlashPark business opportunity work? The answer is yes ... but it's unclear how much money you would be likely to earn from it. And the parking industry is a controversial one.

In February 2005 an article in the London Evening Standard reported that Costas Constantinou, the owner of Vehicle Clamping Services, had been awarded the first prize in the RAC's annual Dick Turpin award. The RAC said that Costas Constantinou had been singled out for the volume of nominations and his company's huge release fees. At that time, VCS demanded £423 for a vehicle that had been clamped and towed away, topped up by a £35 a day storage charge. Costas Constantinou said, "The parking industry does not have happy customers".

The BBC website carries the same story, and this states that when they contacted Costas Constantinou, "He defended his charges which he said were necessary to ensure the 'job was done properly'".

The Guardian website also refers to the Dick Turpin award in a 2005 article, stating that "Among the firms at the forefront of the controversy is Vehicle Clamping Securities" run by Costas Constantinou. They were, however, unable to contact Costas Constantinou for comment.

In a 2006 article, the Guardian website again refers to Vehicle Control Solutions as having won the Dick Turpin award, and this time they succeeded in contacting Costas Constantinou for comment. He said that Vehicle Control Solutions would comply with the new voluntary code drawn up by the British Parking Association, which limits clamp release fees to £125. Costas Constantinou told the Guardian that clamps would soon be replaced with security cameras which recognise number plantes and could automatically issue penalty notices to cars without parking permits.

Costas Constantinou contacted us in November 2010 to tell us that the story in the London Evening Standard is is not true and, as a result of this, he says that the London Evening Standard took the story down from its web site.

No doubt this means that the BBC and the Guardian stories are not true, either - although the only statement which Costas Constantinou has specified as being untrue was the London Evening Standard's claim that he is a clamper, because he says that he has never "been a clamper". Costas Constantinou previously described himself on company documents as a clamping contractor, and on the company documents for Vehicle Control Solutions Ltd he describes himself as a businessman.

Despite the high clamping charges, one of Costas Constantinou's companies - Vehicle Clamping Securities Ltd - sadly went into creditors voluntary liquidation in December 2005 with an estimated total deficiency of £86,254, largely made up of VAT, PAYE and NIC and Corporation Tax.

Have matters improved in the clamping industry in general since 2006? According to postings on various public forums, the answer up until the date of this report (May 2009) is no.

Regulation is now on the way. According to a government press release, on 2nd April 2009 Home Secretary Jacqui Smith announced that the Home Office will look at " ... proposals for introducing compulsory licensing to tackle the limited number of wheel clamping companies whose dodgy practices include:

- excessive penalties for releasing clamped cars

- towing cars unreasonably quickly after being clamped

- hidden, missing or confusing signs warning drivers that clamping takes place

- a lack of any appeals process for drivers.

Currently, any individual undertaking wheel clamping must hold a frontline licence from the Security Industry Authority, with supervisors or directors holding a non-frontline licence. The new proposals would make it mandatory for the company itself to be licensed to help ensure it upholds standards of conduct, which ill be enforced if they are not met.

The Home Office will launch a formal consultation at the end of April considering how best to regulate the industry.

Jacqui Smith said, "The licensing of individual wheel clampers has gone a long way to reducing criminality and improving standards in the industry, but it has become clear that the existing licensing scheme does not address all the concerns the public have.

There are clearly a miniority of clamping companies indulging in unacceptable behaviour including unclear signage and excessive fees."

The parking fees now charged by Vehicle Control Solutions are £85, or £65 if paid within 7 days. It's likely that these will be reduced under the new regulations, but they probably won't come into effect for another year or more.

For the moment, then, all you would have to do as a FlashPark agent is get local customers (i.e. owners of land where there is unauthorised parking) and then sit back and wait for your 25% share of the paid fees to come in. It's the landowner who, having put up the warning signs provided by FlashPark on their property, then has the job of spotting illegally parked vehicles and taking photographs of them which they send via email to the company. FlashPark then sends out by post to the vehicle owner the demands for payment of the parking charges. Oddly, it seems that no parking charge ticket is put on the vehicle at the time.

You wouldn't be involved in any further measures such as clamping and towing away, which Vehicle Control Solutions takes care of ... although this is where the big money is.

One of the problems with the FlashPark offer is that you would always be in the dark - you wouldn't know how many parking charge tickets had been issued or how many had been paid.

It would be useful to know what proportion of tickets is normally unpaid, and we've written to Costas Constantinou to ask him about this. Certainly, on the Internet forums there are signs that vehicle owners are simply not paying the fines or are fighting back by disputing the charges.

They say as follows:

"If you get an unfair ticket in a private (different rules apply to public tickets) car park.... don't pay it. These supposed 'fines' are ... often unenforceable. This is a step by step guide on how to fight them."

Money Saving Expert stresses that their advice is about unfair tickets. They say:

"Of course, landowners have a right to charge for and police proper parking. If you’ve broken those rules, and you think the ticket isn’t exorbitant, I’d urge you to pay up.

If you DO think it's exorbitant, one route is to simply pay what you think is right, eg the equivalent to what you’d be charged on a public road.

... So if you’ve had a ticket you believe is unjust, as is ridiculously common, don’t worry, you can fight it."

The reality of the matter is that if the landowner puts up a number of clear, unmissable signs setting out the charges clearly and warning of clamping then few motorists are likely to park there. And, if they do park there, then the case would be unlikely to hold up in court unless the parking company, in addition to being able to show that the warning signs were unmissable, could also show all of the following:

1. a photograph of the driver with the car; and

2. evidence of the time that the car was parked there; and

3. evidence that the £85 fee is a reasonable amount for damages for breach of contract.

If the landowner only puts up one or two signs and motorists could miss seeing these, then it's more likely that people will carry on parking there. But if the notices could be missed or if it's not clear what land they relate to, then there's even less chance of the charges standing up in court. And if motorists do a search on the Internet then they'll find advice about how to contest the charges.

We've written to Costas Constantinou with a few questions, as follows:

1. Why do you say there are no set up costs when you charge a set up fee of £138?

2. There is a growing movement on the Internet not to pay private parking tickets. Your own tickets would seem to be unenforceable, not least because you do not instruct landowners to take a photo of the driver as well as the vehicle. What percentage of your parking tickets are normally paid?

3. Would you be happy to give people interested in FlashPark the contact details of, say, five of your existing agents so that they can speak to them before joining?

We didn't receive any reply from Costas Constantinou, but he contacted us in November 2010 saying that he never received our letter.

Update 11th November 2010:

Costas Constantinou has certainly risen above his negative press of a few years ago. He is now in demand by the media as a spokesman for the responsible side of the clamping and private parking ticket industry.

For example, Costas Constantinou appeared on BBC London News on 17th August 2010 alongside Caroline Pigeon, leader of the Liberal Democrat London Assembly Group, and denounced people who "go out there, clamp people and charge an absolute fortune". Asked for his views on the ban on clamping on private land which the government had just announced would be introduced in the Freedom Bill in November and which could be in place early next year, Costas Constantinou said that "the ban is a good thing".

And hats off to Costas Constantinou for having already closed his clamping service even though the ban will not take effect for several months.

The Flashpark business opportunity is no longer available, Costas Constantinou informs us. Nevertheless, we are leaving this review live because car clamping and private parking tickets are topics of considerable interest to motorists.
